1. Electronic Record

These Terms & Conditions constitute an electronic record and are published in accordance with applicable law. This electronic record is generated by a computer system and does not require physical or digital signatures.

2. Definitions

"Company", "IshaanPay", "we", "us", or "our" means Ishaanpay Private Limited.

"Platform" means the IshaanPay website, mobile application, software interfaces, communication systems, and related digital channels through which services are made available.

"User", "you", or "your" means any individual, customer, merchant, business user, or other entity accessing or using the Platform.

"Merchant" means a business, retailer, service provider, or other commercial user using IshaanPay in connection with payments, collections, or related service flows.

"Services" means the services or service categories made available on the Platform from time to time, including, where applicable, bill payments, recharge services, credit card bill payments, FASTag-related payments, travel-related services, broadband or utility-related services, e-commerce-related flows, healthcare-related flows, and other categories displayed on the Platform.

"Third-Party Provider" means any bank, biller, payment processor, travel partner, technology partner, infrastructure provider, merchant, service provider, regulated entity, or external platform connected with any Service.

3. Nature of the Platform

IshaanPay acts as a platform / facilitator for transaction initiation, routing, processing support, settlement support, and related service enablement made available through the Platform.

Depending on the Service category, IshaanPay may provide a technology layer, facilitation interface, partner-integrated service access, transaction support, or communication support. Certain Services are delivered, processed, confirmed, fulfilled, or supported by Third-Party Providers.

Unless expressly stated otherwise, IshaanPay should not be interpreted as the direct provider of every Service available on the Platform.

4. Acceptance of Terms

By using the Platform, you confirm that:

  • you have read and understood these Terms & Conditions
  • you agree to comply with them
  • you are legally capable of entering into a binding agreement
  • the information submitted by you is accurate and complete

If you use the Platform on behalf of a business or organization, you confirm that you are authorized to bind that business or organization to these Terms & Conditions.

5. Eligibility

To use the Platform, you must:

  • be at least 18 years of age or the age of majority in your jurisdiction
  • have the legal capacity to enter into a binding contract
  • use the Platform only for lawful purposes
  • provide accurate, current, and complete information when required

We may refuse access, suspend service, or require additional verification if eligibility conditions are not met.

6. Account Registration and Security

To access certain Services, you may be required to create an account or complete a registration or onboarding process. You agree to:

  • provide accurate and complete registration information
  • keep your account details updated
  • maintain the confidentiality of your login credentials
  • take reasonable care to prevent unauthorized access to your account
  • notify IshaanPay promptly if you suspect unauthorized use, fraud, or security breach

You are responsible for activity carried out through your account, except to the extent caused by our verified fault.

7. Verification and Information Requests

IshaanPay may request additional information, documents, declarations, or verification records at any time for onboarding, fraud control, support handling, service activation, legal compliance, or partner requirements.

Failure to provide requested information may result in delayed activation, restricted access, suspended usage, or termination of the relevant Service.

8. Services Available on the Platform

The Platform may provide access to one or more of the following categories, subject to availability and applicable conditions:

  • utility and bill payments
  • recharge services
  • credit card bill payments
  • FASTag-related payments
  • broadband and communication-related payments
  • travel-related services
  • e-commerce-related payment flows
  • healthcare-related payment flows
  • business-facing service utility features
  • any additional categories displayed on the Platform from time to time

IshaanPay may add, modify, suspend, restrict, or discontinue any Service at any time where reasonably necessary for technical, operational, legal, security, partner-related, or business reasons.

9. Convenience Fee, Service Fee, Charges, and Taxes

Customers may pay a convenience fee or service fee in connection with certain transactions. Such fee is ordinarily collected by the merchant from the customer. IshaanPay acts as a platform / facilitator for transaction processing and settlement and does not independently collect such fee from the customer unless specifically disclosed on the Platform or at the point of transaction.

All rates are exclusive of Goods and Services Tax (GST) and any other applicable taxes, unless expressly stated otherwise. Applicable Tax Deducted at Source (TDS) shall apply wherever required under applicable law.

The Service Fee is non-refundable in the event of transaction cancellations, chargebacks, or refunds, unless otherwise expressly stated by IshaanPay in writing for a specific Service.

10. User Responsibilities

By using the Platform, you agree that you will:

  • provide true, accurate, and complete information
  • use the Platform only for lawful, genuine, and authorized purposes
  • comply with applicable laws, regulations, and service requirements
  • ensure that all transactions submitted by you are accurate and authorized
  • keep account credentials confidential
  • cooperate with support, verification, audit, or dispute-resolution requests
  • promptly update material changes to your account or business details, where relevant

11. Prohibited Activities

You must not:

  • use the Platform for unlawful, deceptive, abusive, or fraudulent activity
  • submit false, misleading, or unauthorized information
  • attempt unauthorized access to any system, account, or data
  • interfere with the integrity, availability, or security of the Platform
  • use the Platform in connection with prohibited or restricted transactions
  • engage in activity that could harm IshaanPay, other Users, Merchants, or Third-Party Providers

IshaanPay reserves the right to investigate misuse and take action including restriction, suspension, termination, refusal of service, and reporting to relevant authorities or partners where appropriate.

12. Fraud Prevention

IshaanPay may use automated monitoring tools, manual review, risk checks, and partner-side verification processes to detect and prevent fraud, suspicious activity, abuse, or unauthorized use.

Where fraud or misuse is suspected, we may place transactions under review, limit access, request further information, or suspend services pending verification.

13. Third-Party Providers and Partner Dependency

Certain Services depend on Third-Party Providers. IshaanPay is not responsible for partner-side outages, provider-side confirmation delays, external booking restrictions, biller-side failures, bank-side delays, or fulfillment issues attributable to a Third-Party Provider.

Category-specific rules, including confirmation, booking, cancellation, refund, rescheduling, settlement, and availability, may be governed wholly or partly by the relevant Third-Party Provider.

14. Travel and Partner-Led Services

Travel services available on IshaanPay are partner-led services. The underlying booking, reservation, issuance, fulfillment, or related processing is handled by authorized third-party partners.

IshaanPay acts only as a platform / facilitator for such services and does not claim independent IRCTC authorization unless expressly disclosed.

15. Transactions and Confirmation

A transaction shall be treated as successful only when a valid confirmation, success status, booking confirmation, acknowledgment, or equivalent completion message is generated on the Platform or by the relevant Third-Party Provider.

You are solely responsible for checking all transaction inputs before submission, including amount, biller details, customer details, account or service number, booking details, travel details, mobile number, payment source details, and any other required Service input.

IshaanPay shall not be responsible for failed processing, wrong payment, delayed confirmation, or booking issues caused by inaccurate, incomplete, or incorrect information submitted by you.

16. Customer Support

IshaanPay provides customer support for Services made available through the Platform, including Services that may be facilitated, processed, or fulfilled through Third-Party Providers.

Users may contact IshaanPay directly for support, transaction-related queries, complaints, and service assistance. Where a Service depends on a Third-Party Provider, IshaanPay will provide user support and coordinate further review or resolution as reasonably required.

17. Communication

By using the Platform, you agree that IshaanPay may send communications through available channels including email, SMS, app notifications, website notices, account alerts, service-related messages, support communications, technical notices, and security alerts.

18. Intellectual Property

All content on the Platform, including text, branding, logos, graphics, design elements, software, layouts, interfaces, and other materials, is owned by or licensed to Ishaanpay Private Limited unless otherwise stated.

You may not copy, reproduce, modify, republish, distribute, display, transmit, or commercially exploit any part of the Platform without prior written permission, except as permitted by law.

19. Disclaimer

The Platform and all Services are provided on an "as is" and "as available" basis. To the maximum extent permitted by law, IshaanPay does not guarantee that the Platform will always be uninterrupted or error-free, all Services will remain continuously available, every transaction will be processed successfully, every Third-Party Provider will perform without delay or issue, or the Platform will be free from technical interruption, outages, or operational disruption.

20. Limitation of Liability

To the maximum extent permitted by law, IshaanPay shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising out of or in connection with use of or inability to use the Platform, Service failure caused by a Third-Party Provider, user input errors, delayed confirmations, provider-side reversals, partner-side booking issues, infrastructure downtime, service interruptions, or unauthorized access not caused by our proven fault.

Nothing in these Terms & Conditions excludes liability to the extent such exclusion is prohibited by applicable law.

21. Indemnity

You agree to indemnify and hold harmless Ishaanpay Private Limited, its directors, officers, employees, affiliates, partners, service providers, and representatives from claims, losses, liabilities, damages, costs, and expenses arising from your breach of these Terms & Conditions, your misuse of the Platform, your violation of law, your violation of third-party rights, your submission of unauthorized, inaccurate, misleading, or fraudulent information, and your transactions or activities carried out through the Platform in breach of these Terms.

22. Suspension and Termination

IshaanPay reserves the right to suspend, restrict, disable, review, or terminate access to the Platform or any Service where reasonably necessary for legal compliance, risk management, maintenance, security, fraud prevention, policy enforcement, verification failure, partner requirements, misuse, or suspicious activity.

23. Changes to These Terms

IshaanPay may revise these Terms & Conditions from time to time. The updated version will be published on the Platform with the revised effective date or last updated date.

Your continued use of the Platform after publication of revised Terms constitutes your acceptance of the updated Terms.
